El proyecto pretende analizar procesos de exigibilidad en experiencias de acceso a derechos con poblaciones atravesadas por el control social punitivo. En veinte años de investigación en la temática, la noción de espacio carcelar reconoce significaciones atribuidas al adentro-afuera de la prisión que la muestran porosa, permeable y evidencian su trascendencia en familiares, allegados/as de personas privadas de libertad, jóvenes en conflicto con la ley penal y personas liberadas. Resultados de investigaciones expresan condiciones subjetivantes en respuestas individuales y colectivas que interpelan sentidos hegemónicos del derecho, mostrando resistencias y transversalidades que permiten hipotetizar respecto de otra cara del espacio carcelar, como proceso que induce a la politicidad colectiva del sufrimiento padecido. Desde un posicionamiento interdisciplinario que articula la Psicología Social la Criminología Crítica, la Sociología Clínica y las Ciencias de la Educación, transversalizado por enfoque de derechos, nos interrogamos sobre: ¿Qué procesos de exigibilidad es posible reconocer en experiencias de acceso a derechos de las poblaciones atravesadas por el control social punitivo? ¿Qué condiciones sociohistóricas, institucionales y procesos psicosociales median entre el reconocimiento, el ejercicio y la exigibilidad de derechos? ¿Qué prácticas de subjetivación se desarrollan en dichas experiencias y qué sentidos construyen al respecto los sujetos implicados?La propuesta de indagación se enmarca en el paradigma construccionista, la epistemología subjetivista y procedimientos plurimetodológicos cualitativos. Entre estos, la observación participante, las entrevistas semiestructuradas y los grupos de discusión permitirán acceder a las tramas psicosociales y comprender los sentidos construidos por los sujetos singulares y colectivos al interior de sus prácticas y a la manera en que negocian las condiciones que le son particulares. Los grupos serán seleccionados por muestreo intencional y accesibilidad en busca de captar los procesos y sentidos construidos en las experiencias de acceso a derechos y su exigibilidad. Para el procesamiento y análisis de datos se utilizará el método comparativo constante a fin de fundamentar teoría en los datos, desde el cruzamiento de las interpretaciones de la experiencia, las perspectivas de diferentes actores y la mirada analítica de los/as investigadores/as.

Processes of Enforceability in Experiences of Access to Rights among Populations Subject to Punitive Social Control

Abstract

This project aims to analyse processes of rights enforceability in experiences of access to rights among populations subject to punitive social control. Over twenty years of research on this topic, the concept of “carceral space” recognises meanings attributed to the inside and outside of the prison that reveal it to be porous and permeable and demonstrate its broader reach among family members and close associates of incarcerated persons, youth in conflict with the law, and former inmates. Research findings reveal subjectivizing conditions in individual and collective responses that challenge hegemonic meanings of law, showing forms of resistance and transversalities that allow us to hypothesise about another facet of carceral space, as a process that gives rise to the collective politicization of the suffering endured. From an interdisciplinary standpoint that brings together Social Psychology, Critical Criminology, Clinical Sociology, and the Educational Sciences, with a rights-based approach cutting across these fields, we pose the following questions: What processes of rights enforceability can be identified in experiences of access to rights among populations subject to punitive social control? What socio-historical and institutional conditions, as well as psychosocial processes, mediate between the recognition, exercise, and enforceability of rights? What practices of subjectivation unfold in these experiences, and what meanings do the social actors involved construct in this regard? This research proposal is grounded in the constructionist paradigm, subjectivist epistemology, and qualitative multi-method procedures. Among these, participant observation, semi-structured interviews, and discussion groups will provide access to the psychosocial configurations and enable us to understand the meanings constructed by individual and collective subjects within their practices and the ways in which they negotiate the conditions specific to them. The groups will be selected through purposive sampling and accessibility, with the aim of capturing the processes and meanings constructed in experiences of access to rights and their enforceability. For data processing and analysis, the constant comparative method will be used to ground theory in the data through the cross-referencing of interpretations of experience, the perspectives of different actors, and the researchers’ analytical perspective.
